Summary:
This is for your session fee and does not apply to any print purchases. There are no refunds for session fees of any kind. Session fees cover the time and talent of the photographer. If you are not happy with your session images, if agreed upon with the photographer, a reshoot may occur. If no reshoot is agreed upon, the session fee still applies to the initial session and no refund or credit will be given. All print purchases are made separately from this purchase. You agree to give the photographer artistic license to capture your images. The photographer and studio will take the utmost care concerning the exposure, development, and delivery of photographic products and services ordered. The studio also reserves the right to use negatives, digital captures, and/or reproductions for display, exhibitions, contests, and other purposes. Unless specifically stated herein, negatives, digital negatives, and proofs remain the studio's property, and the studio has the exclusive right to make additional reproductions from them for the client.
Notice of Copyright: The studio owns all copyrights to commissioned images. With commercial sessions, the studio provides permission for the client to use their digital images for personal reproduction and without financial gain. The purchase of digital images authorizes you to make prints and reproductions for personal usage; unless this is a commercial session where TML Studio is then authorized.
1. Services and Deliverables
The Photographer agrees to provide photography services as described in the agreed package, including the delivery of high-resolution digital images. Additional services (such as prints or extended sessions) will incur additional fees.
2. Payment Terms
The Client agrees to pay a 100.00 deposit upon signing this agreement, which will secure the booking. The remaining balance is due on or a minimum of 24 hours before the scheduled session date. Payments can be made via PayPal, credit card, or debit/cash(the day of is allowed). Deposits are non-refundable but at the discretion of the photographer.
3. Rescheduling and Cancellation
If the Client needs to reschedule, notice must be provided at least [number of days] in advance. If rescheduled within the notice period, the deposit can be transferred to the new date. Cancellations within [number of days] of the scheduled date will forfeit the deposit. If the Photographer must cancel due to unforeseen circumstances, a full refund of all paid fees, including the deposit, will be issued.
4. Intellectual Property and Copyright
All images created by the Photographer are protected under Canadian copyright law. The Photographer retains full copyright of all images. The Client is granted a limited license for personal use of the digital images provided. Commercial use or reproduction of images requires written permission from the Photographer and may be subject to additional fees.
5. Image Usage Rights and Model Release
The Client agrees that the Photographer may use images from the session for promotional purposes, including portfolio display, website, social media, and marketing materials, unless a prior written request is made to opt out. A model release may be requested to allow for broader usage rights.
6. Image Delivery and Editing
The Photographer will deliver digital images within [number of days/weeks] of the session date. Basic editing is included, which consists of color correction, exposure adjustments, and light retouching. Extensive editing (such as altering body shape or additional retouching requests) will be quoted and billed separately.
7. Liability and Indemnity
The Photographer takes no responsibility for unforeseen circumstances, including but not limited to weather, location access issues, or technical failures. The Client agrees to indemnify and hold the Photographer harmless against any claims, damages, or liabilities arising from the session or usage of images.
8. Force Majeure
Neither party shall be held responsible for any delay or failure to perform due to circumstances beyond their control, such as natural disasters, acts of war, government restrictions, or other events of force majeure. Should such circumstances occur, the Photographer will work with the Client to reschedule the session.
9. Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of Ontario, Canada. Any disputes arising from this agreement shall be resolved in a court located within Ontario.
10. Acceptance of Terms
By signing below, the Client agrees to all terms and conditions outlined above and consents to proceed with the photography services provided by TML Studios.
